In 2013, an Ohio judge admitted to probate a Will written entirely with an electronic stylus pen on a Samsung Galaxy tablet and later signed electronically by the testator and witnesses.  In 2017, the concept of an electronic Will or “e-Will” has become a hot topic with the help of a for-profit company seeking to procure favorable legislation in Florida and beyond.  Not all agree that electronic Will legislation as being proposed is a good idea.  Do you?

Kyle Gee will provide background into the concept of electronic wills by explaining factors leading to their creation by emerging generations.  He will also summarize electronic will cases from around the world.  Kyle will share reasons proponents are pushing for enactment of electronic Will statutes and the concerns raised by those in opposition.

Kyle B. Gee, is licensed to practice law in Ohio, Pennsylvania, and New Jersey. He is a Partner with the law firm Schneider Smeltz Spieth Bell, LLP, Cleveland’s oldest law firm. He concentrates in the core areas of estate planning and wealth transfer, administration of estates and trusts, fiduciary representation and litigation, charitable planning, business succession, family foundations, and taxation.

He also writes and speaks on the potential opportunities and hazards created when traditional estate planning intersects with modern technology, such as electronic wills.

Mr. Gee’s sophisticated estate planning approach includes careful consideration of family circumstances, charitable planning opportunities (such as lifetime and testamentary gifts, split-interest trusts, private foundations, and donor advised funds), and taxes (estate, gift, generation skipping transfer, and income taxes).

He guides fiduciaries in their roles as executors, trustees, guardians, and agents through complex federal, state, and local laws and also helps them navigate family dynamics that are frequently complex and challenging. He helps administer estates and trusts in Ohio, Pennsylvania, and New Jersey. In addition, he prepares associated tax returns for individuals, estates, and trusts.

Having begun his career as a law clerk to a Pennsylvania Probate (Orphans’ Court) judge, Mr. Gee counsels clients with added litigation and dispute resolution perspectives.  He earned his J.D. magna cum laude from The University of Toledo College of Law and his B.A. in Communications, Public Relations emphasis, from Brigham Young University.

Mr. Gee routinely represents clients with established careers and businesses.  He also takes special interest in advising emerging professionals and entrepreneurs, parents with young children, and those in retirement.

He is active in his Church’s organization and enjoys travel and outdoor recreation with his wife and children.
